Rules, Terms and Conditions of One Month: The Game


Section 1: Introduction

1.1 Overview of One Month: The Game

Welcome to One Month: The Game (hereinafter referred to as "the Game"), a transformative self-improvement platform created and operated by Bitgreen, a division of Fundación Maracuyá Viva, a Republic of Panama nonprofit foundation, and its affiliates (collectively referred to as "Bitgreen", "we", "our", or "the Company"). The Game leverages blockchain technology, AI, telecommunications, and digital tokens to help players set, track, and achieve personal growth goals over a 28-day period.

1.2 Acknowledgement and Acceptance of Terms

By accessing, participating in, or otherwise engaging with the Game, you (the "User" or "Player") agree to these Rules, Terms and Conditions ("Terms"), as published on April 10, 2025, which constitute a legally binding agreement between you and Bitgreen. If you do not agree to these Terms, you must immediately discontinue your participation in the Game and refrain from using any associated services. The Game provides a structured, goal-oriented experience where users can engage in various personal development activities, receiving digital tokens ("Tokens") based on their performance.

The Game's ultimate objective is to encourage consistency and achievement through positive reinforcement, with Tokens serving as both a stake in the process and an inducement for successful goal completion.

These Terms apply to all interactions, including but not limited to access via WhatsApp, PayPal, token transactions, and third-party integrations (such as AI and blockchain networks) that may be used in the Game. Participation in the Game is subject to your compliance with these Terms, and it is important that you read and understand them fully before using the Game.

Bitgreen reserves the right to modify these Terms at any time. Any changes to the Terms will be effective immediately upon publication. You are responsible for reviewing these Terms regularly, and continued use of the Game after such modifications constitutes your acceptance of the updated Terms.

1.3 Definitions

  1. Big Win: A defined success criterion requiring a User to achieve at least three Week Wins out of four weeks during the gameplay period to return a percentage of their Goal Stake.
  2. Blockchain: A decentralized ledger system used to securely and transparently record transactions.
  3. Blockchain Wallet Address: A unique alphanumeric identifier used to send, receive, and store cryptographic tokens on a blockchain.
  4. Bitgreen: Refers collectively to Bitgreen, the token network, Fundación Maracuyá Viva, Roses Are Free, Corp, and any of their affiliates, employees, contractors, consultants, subsidiaries, or related parties.
  5. Daily Dopamine: Tokens returned to the User for completing daily Goal Sessions within the Game.
  6. Ethereum Network: A specific blockchain network supported by the Game for token payment and withdrawals.
  7. Goal Session: A specific daily activity that the user pledges to complete at least 3 to 7 times per week.
  8. Goal Stake: The number of self-selected crypto tokens a User pays to play the Game. The Goal Stake is not a wager, but consideration for participation.
  9. Goal Stake Return: The return of any portion of Goal Stake depending on a player's consistent progress in the Game, as detailed below. Failure to meet the required criteria may result in the forfeiture of stake.
  10. Hall Pass: Enables a User to skip one session per week without forfeiting the week.
  11. Payment: The act of transferring tokens from a User's wallet to the Game's wallet for Goal Stake or other game-related fees.
  12. Player (or User): Any individual accessing, participating in, or interacting with the Game.
  13. Term: 28 days, or exactly four (4) weeks.
  14. Token: A digital asset recorded on a blockchain, representing, in the case of the Game, a unit of utility.
  15. Token Burning: A process by which a token, or its commensurate market value, is rendered permanently inaccessible, similar to deletion or erasure.
  16. Token Transfer: The act of sending tokens from one blockchain wallet address to another.
  17. Trial Period: Each game starts with a trial period of four (4) days for the player to test the waters and determine whether they want to continue by making a Goal Stake.
  18. Week: One seven (7) day period regardless of the calendar day of the week.
  19. Week Win: A positive evaluation of a Player's weekly performance. A win is accomplished by completing all committed Goal Sessions in a week (e.g. 4 per week), or completing one less session and utilizing a Hall Pass.
  20. Withdrawal: The process by which a User may request to redeem or withdraw their returned tokens after the conclusion of a Game session, subject to the terms set forth in the Game.

Section 2: Eligibility and Requirements to Play

To participate in the Game, players must meet the following requirements:

  1. Age Requirement: You must be at least 18 years of age. If you are under 18, you must have obtained parental or guardian consent to participate.
  2. Active WhatsApp Account: Participation requires a valid and active WhatsApp account, which will serve as the primary platform for interactions within the Game.
  3. Token Availability: You must have access to the necessary tokens for staking (referred to as setting a Goal Stake) in a compatible wallet on supported blockchain networks, such as Ethereum or Base Network.
  4. Commitment to Participation: By entering the Game, you acknowledge that success in One Month requires consistent participation. You must show up, complete your Goal Sessions, and engage with the Game as required, including scheduled check-ins and any necessary updates.
  5. Technical Requirements: You must ensure that you have a compatible mobile device, a stable internet connection, and access to any external services or third-party applications that the Game may require for full participation.
  6. Geographic Availability: The Game may not be available in all regions. It is your responsibility to ensure that participation complies with the laws and regulations of your jurisdiction.

Section 3: Game Mechanics

3.1 Overview

The objective of One Month is to complete a discrete, specific, and measurable activity—one's Goal Sessions—consistently over the game Term. Success is determined on a weekly basis, with a final achievement, The Big Win, at the end of the fourth week.

By consistently completing sessions, checking in regularly, and maintaining a growth mindset, players can recover their Goal Stake and potentially earn additional bonuses.

3.2 Goal Selection

You will begin by designating a specific, measurable personal goal. This can be any activity that is central to your growth, such as:

  1. Exercise (e.g., running, weightlifting, yoga)
  2. Nutrition (e.g., meal planning, dietary habits)
  3. Hobbies (e.g., learning a musical instrument, painting)
  4. Time management (e.g., daily planning)
  5. Breaking a bad habit (e.g., smoking cessation)

You will also choose the frequency of your sessions. This will be your Session Cadence (e.g., four sessions per week, or daily). The Session Cadence must be as low as three (3) days per week and as many as seven (7) days per week.

3.3 Setting the Goal Stake

Upon setting a goal and initiating the Game, you may play for a 4-day trial without creating a Goal Stake. Thereafter, all users who intend to continue playing will set a Goal Stake, which represents a self-declared number of crypto tokens they are committing to the Game. This stake is not a wager; it is payment in full to play the Game, yet can be used as an incentive in your own success and motivation. The stake must be greater than zero and is required for participation.

3.4 Same-Day Session Check-In Process

Each session completed must be followed by a Session Check-In. This involves confirming the completion of your goal action in the Game interface (WhatsApp).

  1. Deadline: Check-ins must be submitted before midnight local time on the same day as the session was completed.
  2. Confirmation: Players must confirm the check-in via the confirmation pop-up. Check-ins without this confirmation will not be counted.

Any missed check-ins will result in an unsatisfied session for that day. There are no exceptions for late check-ins, and retroactive check-ins are not permitted.

3.5 Weekly Results

At the end of each week,a player's progress will be evaluated as win or loss. If you meet or exceed the required number of completed sessions for the week, you will Win the Week. The Game encourages consistency and completion of your sessions, as this is key to returning your Goal Stake.

  1. Winning the Week: Completing the committed number of sessions (e.g., 4 out of 7 days) will result in a win for that week.
  2. Failure to Win: Failing to meet the required number of sessions will result in a loss for that week.

The Big Win: If you complete your sessions for at least three out of the four weeks in the Game, you will win a portion of your Goal Stake back. Your success is evaluated on a weekly basis.

3.6 Hall Pass

The Hall Pass allows you to skip one session per week without forfeiting the week.

  1. Usage: Only one Hall Pass can be used per week.
  2. Deadline: Hall Passes must be activated before midnight on the day of use.
  3. Effect: Using a Hall Pass prevents a Loss for that week but does not return any Daily Dopamine for the missed session.
  4. Rollover: Unused Hall Passes do not roll over to the following week.

3.7 Token Allocation and Return

Your Goal Stake will be divided into two parts:

  1. The Big Win: 50% of the stake is allocated to The Big Win and will be returned if you win at least 3 of 4 weeks.
  2. Daily Dopamine: 50% of the stake is distributed incrementally, with tokens being returned after each completed session.
  3. Burning: Any missed sessions, including Hall Passes, will result in the burning of a portion of your stake. Burning is irreversible and occurs at a programmatic level.

You can withdraw the returned tokens at any time, with withdrawals processed twice per month on the 1st and 15th.

3.8 Example Token Return Table

A typical game setup might look as follow, with a Goal Session Cadence of 4 weekly sessions:

  1. Goal Stake: 1000 BBB tokens
  2. Big Win Allocation: 500 BBB tokens
  3. Daily Dopamine Allocation: 500 BBB tokens
  4. Daily Dopamine Return Per Session: 500 / (4 sessions * 4 weeks) = 16 = 31.25 BBB tokens

Completed sessions and token return:

  1. Week 1: 4 sessions → 125 BBB returned
  2. Week 2: 3 sessions + Hall Pass → 93.75 BBB returned
  3. Week 3: 2 sessions + Hall Pass → 62.5 BBB returned
  4. Week 4: 5 sessions → 125 BBB returned
  5. Total Daily Dopamine Returned: 406.25 BBB tokens
  6. Big Win Return: 500 BBB tokens

Total Return: 906.25 BBB tokens.

3.9 BBB Staking Bonus

The BBB Staking Bonus is an additional incentive for those who stake their Goal Stake using BBB tokens, offering a rewarding boost for your participation in the Bitgreen network. By committing your Goal Stake in BBB, you can receive a bonus that increases your token return upon completing your Goal Sessions.

  1. Eligibility: To qualify for the BBB Bonus, you must stake your Goal Stake using BBB tokens. The bonus applies to only the Daily Dopamine Allocation.
  2. Bonus Rate: The standard BBB Bonus rate is 30% of the returned Daily Dopamine.
  3. Timing: The BBB Bonus will be added to your Daily Dopamine return at the end of the game.
  4. Maximum: As of April 10, 2025, the current maximum BBB Bonus is 15,000 BBB tokens per game.

For example, for a Goal Stake of 1000 BBB tokens, the return might look like this:

  1. Big Win Allocation: 500 BBB tokens
  2. Daily Dopamine Allocation: 500 BBB tokens
  3. From the previous example, session check-ins returned 406.25 BBB from the Daily Dopamine Allocation
  4. BBB Staking Bonus: 30% of 406.25 BBB, or 121.875 BBB tokens.
  5. The final return with the BBB Bonus would be 500 + 406.25 + 121.875 = 1028.125 BBB tokens.

3.10 Refer A Friend Bonus

If you refer a friend to the Game, you may earn a Refer A Friend Bonus. This bonus is based on the amount your referred friend stakes, provided they complete their first full month successfully.

  1. Bonus Factor: A 10% bonus will be awarded to the Referrer's wallet based on the Referee's total stake.
  2. Conditions:
    • The Referee must stake with BBB.
    • The Referee must complete at least three out of four weeks and win their Big Win for the Referrer to receive the bonus. If the Referee forfeits or fails to win their Big Win, the Referral Bonus is forfeited.
  3. Timing of the Bonus: The Refer A Friend bonus will be paid after the Referee has completed playing their first month of the Game.

Section 4: Honor Code

By participating in One Month, you agree to uphold the values of integrity, honesty, and self-accountability throughout the duration of the game. Your commitment to these principles is essential to ensuring a fair and positive experience for all players.

Before beginning the Game, all users must type out and confirm that they fully understand and agree to the following statement:

"I promise to show up this month with integrity and truth. No lies, no false check-ins, no shortcuts. I will win because my power is undeniable, and I have what it takes!"

By agreeing to this Honor Code, you affirm that you will:

  1. Complete your Goal Sessions honestly and to the best of your ability.
  2. Avoid falsifying check-ins or engaging in any deceptive behavior to manipulate your results.
  3. Take full responsibility for your actions and the outcomes of your participation.
  4. Engage with the game in a spirit of personal growth, accountability, and self-improvement.

Failure to adhere to this Honor Code may result in removal from the game, forfeiture of your stake, and the loss of any rewards earned during your participation.

Your commitment to this Honor Code is the foundation of your journey in One Month.

Section 5: Token Nature and Payment Terms

5.1 Arcade Token Functionality

For the sole and exclusive purpose of interacting with the Game, Bitgreen may, at its sole discretion, permit the use of BBB tokens or other tokens that are compatible with Ethereum Virtual Machine (EVM) networks. These Tokens will serve solely as in-game payments or arcade tokens within the Game. Tokens are utilized exclusively to initiate gameplay, receive game-related feedback, and engage with the Game's entertainment platform. Tokens utilized in the Game are not, and shall not be construed as, deposits, securities, depository assets, bonded instruments, stores of value, or contractual obligations of any kind. The Game does not constitute a banking or investment service, and no interest, yield, or financial return is implied, offered, or guaranteed in connection with the use of Tokens within the Game.

5.2 No Promise of Return

By submitting Tokens to Bitgreen for use within the Game or for any related purpose, the User fully and irrevocably forfeits any legal or equitable interest in such Tokens. The User acknowledges and agrees that no claim for refund, redemption, return, or compensation shall arise under any theory of contract, equity, or law. Any potential return, credit, or reimbursement of Tokens shall be made solely at the full and unfettered discretion of Bitgreen, and Bitgreen reserves the right, at its discretion, to withhold, deny, delay, or partially return Tokens without explanation, cause, or remedy.

5.3 Accepted Payment Tokens

Bitgreen may, at its sole discretion, accept other tokens in place of BBB tokens for the purposes of accessing and playing the Game. The eligibility of any token for payment shall be determined exclusively by Bitgreen, which may, at any time and without notice, modify, limit, expand, or revoke the list of accepted tokens. The User acknowledges and agrees that Bitgreen is under no obligation to accept any specific token, even if that token was previously accepted for use in the Game.

5.4 No Representations or Warranties

Bitgreen makes no representations or warranties regarding the market value, liquidity, technological integrity, utility, legality, or stability of any Token, including but not limited to BBB, USDT, USDC, ETH, or any other EVM-compatible token that may be accepted for use within the Game. Bitgreen does not control or influence the networks, exchanges, or protocols that support such Tokens and shall not be held liable for any losses, delays, or failures resulting from third-party systems or smart contracts.

5.5 Volatility and Risk Acknowledgment

The User expressly understands and acknowledges the inherent risks associated with digital tokens, which include but are not limited to extreme price volatility, loss of private keys, potential vulnerabilities in smart contracts, changes in regulatory frameworks, and system failures or protocol malfunctions. The User assumes full responsibility for these risks and agrees to release Bitgreen from any liability arising from any such occurrences, including those resulting from third-party platforms or events beyond Bitgreen's control.

5.6 No Investment or Financial Product

The submission of Tokens for participation in the Game does not constitute an investment, nor does it represent a solicitation for investment or participation in any financial product. Bitgreen makes no claim or suggestion that the use of Tokens within the Game is an opportunity for financial profit, appreciation, or gain. The Game is purely for interactive, entertainment, and engagement purposes and does not offer any financial return or expectation thereof.

Section 6: Payment Process

6.1 Goal Stake Requirement

Upon initiating participation in the Game, users must select and set a Goal Stake within the Trial Period. If the user fails to set a Goal Stake before the end of the fourth day, they will be automatically unenrolled from the Game on Day 5.

6.2 Initiating Payment

To initiate the payment process for setting their Goal Stake, users must type "STAKE" in the WhatsApp chat with Om. This command will direct them to a payment page hosted on https://bitgreen.org.

Important Notice: Users must exercise extreme caution when accessing the payment page to ensure they are on the correct domain: https://bitgreen.org. Any page with a different URL should not be accessed and must be reported to the support team immediately.

6.3 Accepted Payment Methods

Users are able to send payment for their Goal Stake using one of the following methods:

  1. Purchasing BBB Tokens via PayPal: Users can purchase BBB tokens through a secure payment process on https://bitgreen.org.
    1. Staking BBB qualifies the user for the BBB Bonus as discussed in Section 3.8.
    2. Only BBB tokens can be purchased via this method.
  2. EVM-Compatible Token Transfer: Users can transfer existing Ethereum Virtual Machine (EVM)-compatible tokens to the Game for payment. Such tokens include but are not limited to:
    1. BBB
    2. ETH
    3. USDT
    4. USDC
    5. ARB
    6. MATIC

6.4 Completing the Payment Process

Once the user has selected their payment method, they will follow the detailed instructions provided to complete the payment. After completing the payment, users must return to the WhatsApp Game interface and confirm the amount of their Goal Stake by typing it in the chat.

Only after the user declares their Goal Stake within WhatsApp and agrees to these Rules, and Terms and Conditions, will their stake be validated and considered official, and the game continue past the Trial.

6.5 Confirmation and Validity of Goal Stake

A Goal Stake is only valid once confirmed by the system after the user has completed all steps of the payment process, including the confirmation within WhatsApp. Until the confirmation is completed, the Goal Stake is not considered active.

6.6 Irrevocability of Payment

Once the Goal Stake payment has been remitted and processed, the payment is non-recourse, unmodifiable, and irrevocable. The user forfeits all claims to the Goal Stake tokens once payment is made. This means that once a user confirms the payment, they are not entitled to a refund, and no claims can be made to modify or recover the staked tokens.

Section 7: Withdrawal and Redemption

This section outlines the processes and mechanisms related to the withdrawal and redemption of tokens from the game. Players can redeem their earned tokens based on their performance throughout the game, subject to the following conditions.

7.1 Token Redemption Process

To redeem tokens, players must follow the official redemption process, which involves a request to transfer tokens from their game account to their designated blockchain wallet. Tokens returned from Daily Dopamine and The Big Win, after successfully completing the required sessions, are eligible for redemption. Redemption requests are processed on the scheduled dates and are subject to the availability of tokens in the player's account.

7.2 Withdrawal Request Mechanism

Players can initiate a withdrawal by typing the WITHDRAW command in the game interface. The withdrawal request will then be queued for processing.

  • Withdrawal requests are only twice each month. Any request submitted after these dates will be queued until the next scheduled processing date.
  • Once a withdrawal request is submitted, it cannot be canceled or reversed until the processing is complete.

7.3 Timing and Frequency of Withdrawals

Withdrawals are processed and distributed on the 1st and 15th (each the "Processing Dates") of each month, ensuring that players have regular access to their returned tokens.

  • Tokens will be distributed to the blockchain wallet address provided by the player during account setup.
  • Players may request withdrawals at any time, but the actual token transfer will occur only on the Processing Dates.
  • Withdrawal requests will be processed in the order they are received.

7.4 Failed or Incomplete Transactions

Tokens will remain in the User wallet if a withdrawal or redemption transaction fails or is incomplete due to technical issues or errors on the blockchain network.

  • The player may re-initiate the withdrawal request once the issue is resolved.
  • In cases of incomplete transactions, tokens will not be deducted from the player's account until the transaction is successfully completed.
  • For any unresolved issues, players should contact the support team by typing SUPPORT.

7.5 Forfeiture and Non-Return of Tokens

In the event that a player fails to meet the requirements for The Big Win, or if there are missed check-ins or Hall Pass usage resulting in token burns, some portion of the earned tokens may be forfeited.

  • Tokens that are burned due to missed sessions or other performance-related issues are irrecoverably forfeit and cannot be returned.
  • Unredeemed tokens will remain in the player's wallet until the Player institutes a withdrawal request.

7.6 Responsibility for Destination Wallet Address and Indemnification

The User acknowledges and agrees that it is solely their responsibility to designate the correct destination wallet address for any transaction involving the transfer of tokens. Bitgreen shall not verify the validity of the destination wallet address or its ownership. The User understands that Bitgreen will not conduct any test transactions prior to transferring tokens.

In the event of any error in the wallet address provided by the User, including, but not limited to, incorrect, invalid, or non-existent addresses, Bitgreen shall not be held liable for the loss of tokens. Such errors, once the transaction is processed, are irreversible, and tokens sent to an incorrect address will not be recoverable or reimbursable by Bitgreen.

The User agrees to take all necessary precautions and exercise extreme care when submitting the destination wallet address to ensure its accuracy. Additionally, the User agrees to indemnify, defend, and hold harmless Bitgreen, its affiliates, and partners from and against any and all losses, claims, damages, liabilities, and expenses (including legal fees) arising out of any errors made by the User in submitting the wallet address. This indemnity applies whether or not the error was due to negligence, oversight, or any other cause.

Section 8: AI, Om, and Third-Party Providers

8.1 Use of AI, Om (Personal Assistant), and Chat Features

Bitgreen utilizes AI technology, specifically through Om, the personal assistant, to facilitate and enhance your experience in the One Month game. Om is designed to assist with goal-setting, track progress, provide reminders, entertain, and offer support during the user journey. Om also serves as the primary interface for interacting with the Game, sending and receiving messages through platforms like WhatsApp. While Om is powered by artificial intelligence to provide real-time guidance and personalized feedback, the effectiveness of Om's assistance is dependent on the data and inputs provided by the User and its underlying third-party programming.

8.2 Integration of Third-Party Services for Communication, Payments, and Support

In order to deliver a seamless and efficient user experience, One Month integrates with various third-party services. These services may include platforms for communication (such as WhatsApp), payment processors (such as PayPal), blockchain networks, large language models, and support tools. By using these third-party services, the User acknowledges and agrees to their respective terms of service, privacy policies, and any applicable fees. Bitgreen is not responsible for any interruptions, delays, or errors caused by these third-party services.

8.3 Roles and Responsibilities of Third-Party Providers

Third-party providers play an integral role in the functioning of the One Month game. They may handle various aspects of the service, including payment processing, data management, blockchain transactions, or customer support. While Bitgreen works to ensure a secure and reliable partnership with these third-party providers, Bitgreen is not responsible for any actions, omissions, or failures by these providers.

Users are encouraged to review the terms and conditions, privacy policies, and any user agreements provided by these third-party providers. Bitgreen does not guarantee the availability, quality, or accuracy of services provided by these third parties.

8.4 Data Security and Confidentiality in Third-Party Interactions

Bitgreen is committed to safeguarding User data and ensuring privacy in all interactions. When third-party services are involved, such as for communication, payments, or support, Bitgreen will take reasonable steps to protect User data. However, the User acknowledges that data shared with third-party providers is subject to their respective data protection policies and practices, and Bitgreen cannot be held liable for any misuse or unauthorized disclosure of User data by these providers.

Users are encouraged to exercise caution when interacting with third-party services and to only share personal or sensitive information with trusted platforms.

Section 9: Data Privacy and Security

9.1 Privacy Policy and Data Handling Practices

Bitgreen respects the privacy of its Users and is committed to safeguarding the personal data that Users provide. By engaging with the Game, Users agree to the collection, processing, and storage of personal data in accordance with Bitgreen's Privacy Policy, which is available on our website. This Privacy Policy governs the data handling practices of Bitgreen, including how personal data is collected, used, shared, and protected.

9.2 Data Collection and Use

Bitgreen collects and processes personal data that Users voluntarily provide during their participation in the Game, such as account information, communication details, and in some cases payment information. This data is used to operate, manage, and improve the Game, including but not limited to User registration, participation in activities, and facilitating withdrawals. The data may also be used for improving the Game experience, providing customer support, and communicating with Users about updates, promotions, and other relevant information related to the Game.

9.3 Anonymization and Confidentiality of User Information

Bitgreen takes all reasonable measures to anonymize and protect User data received by the Company, where applicable. All sensitive personal data, including payment details, is stored securely and only accessible to authorized personnel or third-party service providers with a need to know. By participating in the Game, Users agree to the processing and retention of their personal information in compliance with the Company's policy. However, any policies, operating procedures, terms and conditions, or otherwise instituted by third-party providers may apply and supersede this section.

9.4 Rights to Access, Modify, or Delete User Data

Users have the right to access, modify, or delete their personal data stored by Bitgreen. This can be done by submitting a formal request via email or contacting customer support. Bitgreen will respond to such requests within a reasonable timeframe, subject to applicable laws. However, Users should note that certain data may need to be retained for legal or operational reasons, such as transaction history related to token activities.

9.5 Compliance with International Data Protection Laws

Bitgreen endeavors to comply with applicable international data protection laws, such as GDPR, where relevant. Users residing in jurisdictions with specific data protection regulations are encouraged to review the Privacy Policy for detailed information on their rights and how Bitgreen complies with these regulations.

Section 10: Intellectual Property

10.1 Ownership of the Game's Content and Assets

All content, assets, and materials related to the Game, including but not limited to game design, code, graphics, artwork, text, logos, and any associated documentation (collectively referred to as the "Game Content"), are the exclusive property of Bitgreen, its affiliates, or its licensors, and are protected by intellectual property laws, including copyright, trademark, and trade secret protections. Users are granted a limited, non-transferable, non-exclusive license to access and use the Game solely for personal, non-commercial purposes, as specified in these Terms. This license does not grant any rights to modify, reproduce, distribute, or create derivative works based on the Game Content.

10.2 User-Generated Content and License Grant

All content, assets, and materials related to the Game, including but not limited to game design, code, graphics, artwork, text, logos, and any associated documentation, and other Game Content, are the exclusive property of Bitgreen, its affiliates, or its licensors, and are protected by intellectual property laws, including copyright, trademark, and trade secret protections. Users are granted a limited, non-transferable, non-exclusive license to access and use the Game solely for personal, non-commercial purposes, as specified in these Terms. This license does not grant any rights to modify, reproduce, distribute, or create derivative works based on the Game Content.

10.3 Restrictions on Reproduction and Distribution

Users are prohibited from reproducing, distributing, displaying, or creating derivative works of any Game Content unless expressly authorized in writing by Bitgreen. Any unauthorized use of the Game Content, including for commercial purposes, is strictly prohibited and may result in the termination of the user's access to the Game, as well as potential legal action.

10.4 Trademarks and Brand Usage

The name "One Month", the Bitgreen logo, the One Month logo, "Om", "The Big Win", "Daily Dopamine", "The Big Start", "Wisdom Drops", other game-specific language, and all other trademarks, service marks, or logos associated with the Game are the property of Bitgreen. Users may not use these trademarks without prior written consent from Bitgreen. Users acknowledge that they have no ownership rights to any trademarks, service marks, or logos associated with the Game, and agree to refrain from using these marks in any manner that may cause confusion or imply an association with Bitgreen beyond the scope of participation in the Game.

Section 11: User Conduct and Responsibilities

11.1 Acceptable Use Policy

Users agree to use the Game, including all features and services, in accordance with all applicable laws, regulations, and guidelines. The User shall engage in activities solely for the purpose of achieving their personal goal in the Game and shall refrain from:

  • Engaging in any fraudulent, misleading, or harmful activities related to the Game.
  • Under any circumstance, operating any external AI or bot services.
  • Disrupting or attempting to disrupt the normal functioning of the Game or Bitgreen's systems.
  • Attempting to reverse-engineer, decompile, or otherwise manipulate the Game's software or blockchain systems.

11.2 Prohibited Conduct and Activities

Users are prohibited from engaging in the following activities:

  • Impersonation: Attempting to impersonate another player, administrator, or any other individual associated with the Game.
  • Cheating: Using any unauthorized scripts, bots, or other third-party software designed to interfere with the Game's operation or Honor Code.
  • Abusive Behavior: Harassing, threatening, or engaging in any form of abusive conduct towards other users, administrators, or support staff.
  • Illegal Activities: Using the Game to engage in any illegal activity, including but not limited to money laundering, fraud, or the transmission of harmful content.
  • Malicious Activity: Introducing malicious code, viruses, or other harmful software that might affect the Game's integrity.

11.3 Account Suspension and Termination

Bitgreen reserves the right to suspend or terminate a User's account if the User violates any provisions of these Terms and Conditions. Suspended or terminated users may forfeit any staked tokens, Daily Dopamine, or Big Win associated with their account.

  • Suspension: A temporary suspension may occur if there is evidence of non-compliance, and the User may be required to rectify any violations before the account is reinstated.
  • Termination: A permanent termination will result in the loss of the User's tokens, any accrued rewards, and forfeiture of future participation in the Game.

Users are entitled to appeal suspensions or terminations by contacting Bitgreen's support team. Bitgreen will investigate any complaints and may reinstate the account at its discretion.

Section 12: Disclaimers and Limitation of Liability

12.1 No Warranty on Game Performance

The Company makes no representations or warranties regarding the availability, accuracy, reliability, or performance of the Game. While the Company strives to provide a seamless and enjoyable experience, there may be instances of service interruptions, delays, errors, or failures that are beyond its control. The Game is provided "as is," and the Company does not guarantee that the Game will be free from defects or errors.

12.2 Limitation of Company Liability

To the fullest extent permitted by applicable law, the Company, its affiliates, employees, contractors, and agents shall not be liable for any damages, losses, or expenses (including, but not limited to, direct, indirect, consequential, incidental, or punitive damages) arising out of or in connection with the Game, including but not limited to:

  • Any loss of data, personal information, or tokens.
  • Any interruptions, errors, or defects in the Game's functionality or performance.
  • Any reliance by the User on any content, advice, or statements provided within the Game or associated platforms.
  • Any failure to complete Goal Sessions or meet Milestones due to technical errors or User actions.
  • Any unauthorized access to the User's wallet or associated blockchain accounts, even if such access arises from User error or negligence.

12.3 Indemnification by Users

By participating in the Game, the User agrees to indemnify, defend, and hold harmless the Company, its affiliates, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising from:

  • The User's violation of these Terms, including the failure to adhere to the Game's rules and guidelines.
  • The User's interaction with third-party services, platforms, or products that are integrated with the Game, including but not limited to blockchain wallets, payment systems, and external platforms.
  • Any errors or omissions by the User in providing information, such as an incorrect wallet address or failure to safeguard personal access credentials.
  • Any act, omission, or behavior that causes harm to other Users or disrupts the Game's services.

This indemnity will apply regardless of whether the claims arise due to User error, negligence, or misconduct.

12.4 Disclaimer Regarding Third-Party Services

The Company may integrate third-party services to facilitate communication, payments, or support. However, the Company makes no representations or warranties regarding the availability, functionality, or security of such third-party services. The User acknowledges that:

  • The Company is not responsible for the actions, omissions, or performance of third-party services or platforms, and any disputes or issues arising from interactions with third-party services must be addressed directly with the third party.
  • The User's use of third-party services is at their own risk and subject to the terms and conditions of the third-party providers.

12.5 No Liability for User-Generated Content

The Company is not responsible for any content submitted, generated, or uploaded by the User in the Game, including but not limited to Goal Sessions, personal information, or any other content that the User may post. The Company reserves the right to remove or modify any content that violates these Terms or is deemed inappropriate, but the Company is under no obligation to monitor or review User-generated content.

12.6 Disclaimer of Specific Performance Obligations

The Company does not guarantee that the User will meet their Goals, milestones, or receive any particular reward or benefit as part of participating in the Game. The completion of any Goal Session or the achievement of a Big Win is subject to the User's consistent effort and performance, and success or failure is not guaranteed by the Company. The User accepts that achieving success is based on their own actions, effort, and compliance with these Terms.

12.7 Force Majeure

The Company shall not be liable for any failure or delay in performance under these Terms, including the Game's operation, caused by events beyond the Company's reasonable control, such as acts of God, war, natural disasters, acts of government, strikes, or other unforeseen circumstances.

12.8 Exclusion of Liability for Token Transactions

The Company is not responsible for any issues arising from token transactions, including but not limited to failed, delayed, or incorrect transactions. The User is solely responsible for ensuring the accuracy and security of their wallet address and for understanding the blockchain transaction processes. Bitgreen will not be held liable for any loss of tokens, whether due to errors in User input or other issues related to the blockchain technology used.

Section 13: Jurisdiction and Dispute Resolution

13.1 Governing Law

These Terms and Conditions, as well as any dispute arising from or relating to the Game, shall be governed by, and construed in accordance with, the laws of the Republic of Panama, without regard to its conflicts of law principles. The user and the Company irrevocably consent to the exclusive jurisdiction and venue of the courts located in Panama City, Panama for the resolution of any disputes related to these Terms.

13.2 Dispute Resolution Process

In the event of any dispute, claim, or controversy arising out of or relating to these Terms, the User agrees to first attempt to resolve the matter through informal discussions with Bitgreen. If such discussions do not lead to a resolution within 30 days, the User agrees to resolve the dispute through binding arbitration under the rules and procedures of JAMS (Judicial Arbitration and Mediation Services), located in New York, New York.

13.3 Arbitration Procedures and Costs

  1. Arbitration Rules: The arbitration will be conducted by a single arbitrator, and the arbitration proceedings will be governed by the JAMS Comprehensive Arbitration Rules and Procedures, which are available on the JAMS website.
  2. Arbitration Location: The arbitration will be held in New York, New York, unless the parties agree otherwise.
  3. Arbitration Fees: The User and Bitgreen agree to equally share the arbitration fees. Each party shall bear its own attorney fees, unless the arbitrator finds that a party has acted in bad faith, in which case the prevailing party may be entitled to recover its reasonable attorney fees and costs.
  4. Decision: The arbitrator's decision shall be final and binding, and may be enforced in any court of competent jurisdiction.
  5. No Class Actions: The User agrees that any dispute will be resolved individually and not as part of a class action, representative action, or collective action.

13.4 Exceptions

Notwithstanding the above, the Company may seek immediate injunctive relief in any court of competent jurisdiction to protect its intellectual property rights or to prevent any unlawful activity, including but not limited to any violation of these Terms or any unauthorized use of the Game.

13.5 Time Limits

Any claims arising out of or related to these Terms or the Game must be brought within one (1) year after the cause of action arises, or they will be barred. This time limit applies to any claims, whether based on contract, tort, or otherwise.

By accepting these Terms, the User acknowledges and agrees to these jurisdiction and dispute resolution provisions.

Section 14: No Guarantees of Performance

14.2 Possible Errors, Limitations, and Feature Changes

The User acknowledges that, due to the beta nature of the Game, there may be errors, bugs, or limitations in its functionality. Features may not work as intended, and the Game may experience temporary downtime or malfunctions. The Company does not guarantee that the Game will be error-free or available at all times. Additionally, the Company reserves the right to modify, remove, or replace any features or functionality at its sole discretion, without prior notice to the User.

14.3 No Guarantees of Availability or Performance

The User understands and agrees that the Game's availability and performance are not guaranteed during the beta phase. The Company may suspend, restrict, or discontinue access to the Game at any time, for any reason, including but not limited to testing, maintenance, or unforeseen technical issues. The User accepts that any such interruption or unavailability will not result in any liability or obligation on the part of the Company.

14.4 Feedback and Improvements

The User agrees to provide feedback to the Company regarding their experience with the Game. The Company may use this feedback to improve the Game or develop new features. The User acknowledges that any feedback provided is voluntary, and the Company is not obligated to implement or act upon such feedback.

14.5 Limitation of Liability

In no event shall the Company be liable for any damages, losses, or costs arising from the use of the Game during its beta phase, including but not limited to any loss of data, business interruption, or any other type of loss incurred due to the incomplete or experimental nature of the Game. The User agrees to use the Game at their own risk, understanding that its features and functionality may change as development progresses.

Section 15: Amendments and Updates

15.1 Right to Modify Terms and Conditions

The Company reserves the right, at its sole discretion, to modify, amend, or update these Rules, Terms and Conditions at any time. Such modifications may be necessary to reflect changes in law, technological advancements, the Game's features, or other relevant circumstances. Any modifications to the Terms and Conditions will be effective immediately upon posting on the official platform or website, and it is the User's responsibility to review these Terms regularly.

15.2 Notice of Changes to the Terms

In the event of significant changes to the Terms and Conditions, the Company will provide reasonable notice to the User by posting a notice on the Game's X account, or via direct communication through the contact details provided by the User. The notice will highlight any substantial changes to the rules, policies, or processes that affect the User's rights or obligations. It is the User's responsibility to ensure that the Company has accurate contact information.

15.3 Acceptance of Revised Terms

By continuing to access, participate in, or engage with the Game after any revisions to the Rules, Terms and Conditions have been posted, the User explicitly agrees to the revised Terms. If the User does not agree with the revised Terms, they must cease participation in the Game immediately. Continued participation after the effective date of any such modifications constitutes the User's acceptance of the updated Terms.

Section 16: Miscellaneous

16.1 Severability

If any provision of these Rules, Terms and Conditions is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the validity of the remaining provisions will not be affected, and the invalid, illegal, or unenforceable provision will be deemed amended to the minimum extent necessary to make it valid, legal, and enforceable.

16.2 Force Majeure

The Company shall not be liable for any delay or failure in performance of any part of the Game due to events or circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, power failures, equipment malfunctions, actions or decrees of governmental bodies, labor disputes, or any other causes beyond the Company's reasonable control. In the event of such a delay or failure, the Company's obligations will be suspended for the duration of the force majeure event, and the Company shall make reasonable efforts to resume performance as soon as possible.

16.3 Entire Agreement

These Rules, Terms and Conditions, together with any applicable agreements, policies, or other documents incorporated herein by reference, constitute the entire agreement between the Company and the User with respect to the Game. This agreement supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, whether oral or written, with respect to the Game. Any amendments to these Terms will be made in accordance with the procedures outlined in the "Amendments and Updates" section.
